  • Chirk Nuisance group litigation successfully defended by Clyde & Co on behalf of Kronospan at the High Court.

We’re proud of our pivotal role in the recent Chirk Nuisance Group Litigation ([2025] EWHC 2429 (TCC)) at the High Court in Manchester.

Over 150 claimants alleged that dust, odour and noise emissions from the factory had caused them a public and private nuisance between 2011 and 2017.

But thanks to DustScanAQ’s clear, independent, and scientifically robust expert evidence, the High Court found in favour of the defendant.

Crucially, DustScanAQ’s dust monitoring data collected using our proprietary Directional and Deposited (DustDisc) sticky pad system was accepted by the court as more reliable than the alternative Frisbee method.

And DustScanAQ’s approach in providing objective expert evidence, in tandem with Cambridge Environmental Research Consultants modelling evidence, was preferred by the judge to the claimant’s expert’s approaches.

This outcome not only reinforces the importance of expert-led environmental forensics in legal contexts, but also sets a high standard for future nuisance claims.

Congratulations to the team of Dr Hugh Datson (lead witness), Dr John Bruce (witness support), Paul Eaton, Andrew Green, Sarah Doyle and Gordon Allison for their painstaking contribution to environmental litigation, and for setting the standard in dust monitoring science.
